Legal Reform
The famed 19th century observer of American politics and life, Alexis de Tocqueville, famously wrote that “[s]carcely any political question arises in the United States that is not resolved, sooner or later, into a judicial question.” What was clearly true over a century ago is even truer today. As our political system shrinks away from confronting many of the most difficult questions facing our society, the courts are making more broad-reaching decisions than ever before.

In recent years, the legislative branch has moved aggressively to take some of this power away from the courts. Numerous pieces of legal reform have been proposed, doing everything from capping damage awards to shifting filing procedures to limiting the jurisdiction of federal judges.

The challenge in this area of public policy is ensuring that changes are made in a way that preserves the unique ability of the courts to give individuals a venue to seek justice and protect the public from unconstitutional laws. During his service in Congress, the firm’s leader chaired the Subcommittee on Commercial and Administrative Law, which has the lead responsibility for legal reform in the U.S. Congress. An experienced lawyer and advocate of free enterprise, he understands the importance of enacting legal reforms that balance economic competitiveness with the protection of the legal rights of individuals.
